1. These terms
These Terms and Conditions form a contract between you and Twelve12 Limited, the operator of MyFreebies, when you create an account, post a listing, send a message, save an item or otherwise use the service.
Twelve12 Limited is registered in England and Wales under company number 15070672.
MyFreebies is a free-items marketplace. We provide the website, account tools, listing tools, private messaging and moderation systems. We do not own the listed items and we are not a party to collection arrangements between users.
2. Accounts
You must be at least 18 years old to create an account. You must provide accurate account information, keep your login details secure and tell us if you think your account has been misused.
You are responsible for activity carried out through your account, including listings, messages, reports and collection arrangements. We may suspend or close accounts that breach these terms, misuse the service or create safety, fraud or legal risk.
3. Free-only listings
Listings must be genuinely free. You must not ask for payment, deposits, delivery fees, cash on collection, tips, subscriptions, swaps or any other form of value through MyFreebies.
You must only list items that you own or have clear permission to give away. Listing descriptions, photos, category, condition and location information must be accurate and not misleading.
4. Prohibited listings
You must not list anything illegal, unsafe, stolen, counterfeit, recalled, age-restricted, hazardous, offensive, adult, medical, prescription-only, weapon-related, or otherwise unsuitable for a public free-items marketplace.
You must not use MyFreebies for commercial dumping, spam, scams, lead generation, advertising unrelated services, harassment, discrimination or attempts to move users into unsafe payment or contact channels.
5. Location privacy and exact pins
When you create a listing, you choose the public location mode. Town-only and approximate modes protect the exact pickup point. Exact public pin mode intentionally shows the exact public marker on the listing page.
Only choose an exact public pin where you are comfortable making that spot public, for example a safe roadside pickup point for soil, sand, bricks or other outdoor materials. Do not publish a private home address unless you fully understand the privacy and safety risk.
6. Messaging and conduct
Private messages are provided to help users arrange collection. Do not send abusive, threatening, discriminatory, sexual, misleading, spam or scam messages. Do not request payment details.
Messages are visible to the conversation participants. We may preserve or review records where needed to investigate reports, enforce these terms, protect users, comply with law or respond to lawful requests.
7. Collection arrangements
Users arrange collection between themselves. You should inspect items, assess lifting and transport needs, meet safely, take another person where appropriate and stop the collection if anything feels wrong.
Owners should make items safe to collect and describe any faults, damage, missing parts, electrical risks or handling risks. Collectors are responsible for deciding whether an item is suitable before taking it.
8. Reports and moderation
Users can report listings that appear paid, unsafe, misleading, suspicious, prohibited or wrongly located. We may remove listings, hide content, restrict messaging, suspend accounts, preserve evidence or report serious matters to the relevant authority.
Moderation decisions are made to protect the service and its users. We are not obliged to publish, restore or keep any listing or message that we believe breaches these terms or creates risk.
9. Your content
You keep ownership of the text, photos and other content you upload. You give us a worldwide, royalty-free licence to host, copy, display, moderate, resize and use that content for operating, improving and promoting MyFreebies.
You must not upload content that infringes another person's rights, breaches confidence, includes private information without permission or contains unlawful material.
10. Availability and changes
We aim to keep MyFreebies available, but we do not guarantee uninterrupted access. We may update, suspend, restrict or withdraw parts of the service for maintenance, security, legal, operational or business reasons.
We may update these terms. If a change is material, we will take reasonable steps to bring it to users' attention. Continued use after the effective date means you accept the updated terms.
11. Liability
MyFreebies is provided as a listing and communication platform. We do not guarantee that listings are accurate, items are safe, users will attend collection, or items will meet your expectations.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or rights that cannot legally be excluded.
12. Businesses and legal compliance
If you use MyFreebies as a business, charity, trader, house-clearance operator or other organisation, you are responsible for complying with all laws that apply to your items, communications, safety duties, waste duties, consumer information and record keeping.
Consumer rights and other statutory rights are not affected by these terms.
13. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction, except where consumer law gives you the right to bring a claim somewhere else.
